The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, November 2, 2020 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Newt Stephens Jr. Roll Call Stephens present, Warner present, and Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Stephens led the Pledge of Allegiance and Invocation.

Item #4: Motion was made by Warner and seconded by Whitehouse to approve the minutes of October 26, 2020 with correction to Item #21 adding % sign by Rx 11%, not a $.  Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #7: Motion was made by Warner and seconded by Whitehouse to sign Transcript and Deed on property located in Westport Addition Lots 33 and 34, BLK 2 that was sold in Public Sale on October 26, 2020. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Warner and seconded by Whitehouse to sign Transcript and Deed on property located in Westport Addition Lots 20 thru 12, BLK 12 that was sold in Public Sale on October 26, 2020. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Warner and seconded by Whitehouse to sign Transcript and Deed on property located in Tiger Addition Lots 6 and 7, BLK 34 that was sold in Public Sale on October 26, 2020. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Warner and seconded by Whitehouse to sign Transcript and Deed on property located in Taneha Lots 11 and 12, BLK 14 that was sold in Public Sale on October 26, 2020. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Stephens and seconded by Warner to Accept Bid#21-5 One or More New or Used Road Graders for District #3 with financing and pass for one week until 11-9-20 for review. Bids submitted by Yellowhouse Machinery Co. of OK, Equipment Share and OCT Equipment LLC. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Motion was made by Stephens and seconded by Whitehouse to Accept Bid#21-6 Preparation of the 2020 Tax Statements for the Creek County Treasurer and comeback to item to award or pass for 1 week, by the end of meeting. Bids submitted by Peregrine Services Inc. for $20,297.50 and Automated Mail Services for $18,562.00. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye. A motion was made by Warner and seconded by Whitehouse per the recommendation of Don Engle, Treasurer award Bid#21-6 to Peregrine Services Inc., Engle stated that he has used them for the last four years and they have included references to call. I would prefer to work with someone I know. Automated Mail Services has bid in the past and has been three times higher, I just don't know anything about the company and they did not include any references to call. Stephens stated per statute if you do not go with the lowest, you must state a reason for it to be the best bid. Stephens asked Goforth is that enough to satisfy the requirements, Goforth stated he has given his reason, I believe so.  Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #19: Motion was made by Warner and seconded by Whitehouse to sign State Local Agreement for the grant award for GIS NG911 Readiness, in the amount of $52,774.00, this is an 80/20 grant and the Counties portion to be paid out of WR-911 Account. Warner stated that with INCOG's help the County was able to receive this grant to help update our GIS, some of our information has become out dated and we need someone to update, format and convert data. Warner stated the Counties portion would be around $11,000.00 - $12,000.00 and is very much needed in the next generation 911 system. Mortazavi asked if INCOG will be monitoring and overseeing the grant, so that we are following the grant terms correctly. Also, within the agreement does it lay out the term that the County Clerk's Office is responsible for, so that at the end we do not get handed a document asking to answer question on procedures that we didn't have anything to do with. Goforth stated that within this agreement and application it lays out the Counties duties and responsibilities. Stephens also stated the same. Goforth stated anything that may change or be updated will be a line item on agenda for everyone to know about.  Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #20: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2020-139 surplussing two CPU INV#610.287 and INV#610.98 and Sonic Wall INV#610.305 Treasurer's Office and Resolution#2020-139A disposing of the same by donating to Gypsy Public School. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #21: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2020-140 establishing the County Holiday Schedule for 2021 as follows: 1-1-21, 1-18-21, 2-15-21, 5-31-21, 7-5-21, 9-6-21, 10-11-21, 11-11-21, 11-25-21 and 11-26-21, 12-23-21 and 12-24-21. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #22: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2020-141 directing the Creek County Treasurer to credit the Creek County General Government Maintenance and Operations Fund 001-1-2000-2005/R2 with funds from the Creek County Court Clerk's Office Fund for reimbursement of utility payments in the amount of $1,917.83, as per Title 62 O.S. § 335, and procedures implemented by the State Auditor's Office. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #23: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from Creek County Rural Water District #2 per County Specs for water service line by boring 45' ditch to ditch, size of line 1", size of casing 3", to cross 3970 W. 91st St. S. Tulsa, OK approximately W. of INT. of 91st St. S. & 33rd W. Ave, further described as 2300' W. of the S.E. corner Section 16, T17N, R12E in District #1. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #24: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from Oklahoma Natural Gas Company per County Specs for natural gas pipeline by boring, size of line 2" HDPE, to cross W. 91st St. approximately 1.55 miles N. and 1.31 miles W. of US-75 & Creek Turnpike further described as 1,721' W. of the S.E. corner of Section 16, T18N, R12E and the N.E. corner of Section 21, T18N, R12E in District #1.  Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #25: Motion was made by Warner and seconded by Whitehouse to approve Utility Permit from Magellan Pipeline Company LLC per County Specs for 8" pipeline by trench cut, size of line 8", to cross S. 209th W. Ave N. of W. 71st St. approximately 1.5 miles N. of intersection in Section 2, T18N, R10 in District #2. Paul Farris, Project Coordinator stated that they are doing a repair and will replace gravel when repair is complete. Warner asked that Paul get with Tim on what type of rock he would like. Warner stated we have been working that road for chip seal. Vote as follow: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #26: Motion was made by Warner and seconded by Whitehouse to extend Resolution#2020-87 one more week until 11/9/20. Covey Murray, Emergency Management stated from Thursday to Thursday we have had 17 new cases and 39 deaths, since last Thursday. We have 152 active cases; I have not received any updates from the Health Department since Thursday. Stephens and Warner both stated that we are down overall by 8 cases, from last Saturday to Friday we dropped from 168 to 160 total cases.  Warner stated with this resolution in place, we have not had any cases within the Court house that I am aware of, so I would extend the current resolution. Vote as follow: Stephens - No, Warner - Aye, Whitehouse - Aye.
