The Board of County Commissioners of Creek County (BOCC) met in Emergency Session on Tuesday, May 21, 2019 at 11:30 a.m., date and time duly posted.
Item #1: Meeting was called to order at 11:44 a.m. by Chairman, Leon Warner. Roll Call Warner present, Stephens present, and Whitehouse absent. Also, Andrew Goforth, Assistant District Attorney, Dana Logsdon, Deputy Commissioner and Jana Thomas, Purchasing Agent.
Item #2: Statement of compliance with open meeting act-Chairman.
Item #3: Motion was made by Stephens and seconded by Warner to declare a county emergency and temporarily waive county purchasing and competitive bidding in response to wide-spread flooding throughout the county per Title 63 683.11 § (F). Stephens stated that Max Cook had been contacted and is aware of the emergency we have going on. Goforth presented a signed letter to the Board with Max Cook, District Attorney being in agreement that the storms have caused an emergency for the County and temporarily waive the county purchasing and competitive bidding procedures of the Public Bidding Act of 1974 for any expenditure in furtherance of the remediation of the roads and bridges due to current flooding to avert the threat of a catastrophe based on this emergency. Vote as follows: Warner - Aye, Stephens - Aye.
Item #4: Motion was made by Stephens and seconded by Warner to approve additional persons for contract labor and equipment in support of road and bridge safety operations due to flooding. Vote as follows: Warner - Aye, Stephens - Aye.
Item #5: DISCUSSION ONLY/NO ACTION to approve spending off the 3 and 6 month bid list as needed in support of road and bridge safety operations due to flooding. Goforth stated this is just to give notice to the public of what expenditures would be made, there is no action required by the Board. It is covered under item #3. Warner stated he has spoken to ODOT and they are allowing access to all millings that we might need with this emergency. They have stockpiles that are closer than the core if need be.
